1. GENERAL CONDITIONS
1.1 The headings used in this agreement are included for convenience only and will not limit or otherwise affect the following Terms & Conditions.
1.2 With these general conditions of sale, Blomour sells the movable tangible goods indicated and offered for sale on the website https://www.blomour.com/ to any person who purchases remotely.
1.3 The customer undertakes to read these general conditions of sale, in particular the pre-contractual information provided by Blomour, before proceeding to confirm his order, and to accept them by affixing a flag in the box indicated in the Home Page.
1.4 With this contract, Blomour sells the tangible or electronic movable goods indicated and offered for sale on the website https://www.blomour.com/ via telematic tools.
1.5 The goods covered by these general conditions are offered for sale by BLOMOUR by Fausta Bonfrate, VAT number 03286850734.
1.6 Any violation of the Terms & Conditions will result in the immediate termination of the Services.
1.7 The general conditions of sale set out here are to be considered valid exclusively between the Blomour company and any person who makes purchases online on the website https://www.blomour.com/.
1.8 It is not possible, in using the Service, to violate the laws of your jurisdiction (including, by way of example, the laws on copyright, author).
1.9 Any violation of the Terms will result in the immediate termination of the Services.
1.10 By placing an order through this website, you warrant that you are over the age of 18 and have the legal right to enter into binding contracts.
1.11 The information and details contained on this website should not be considered offers to the public: they simply constitute an invitation to customers to conclude business by forwarding purchase proposals.
1.12 The contract is concluded exclusively through the internet, by accessing the address https://www.blomour.com/ and placing a purchase order which must be carried out following the procedure provided for by the aforementioned site.
1.13 All items purchased are for personal use only and with no intention of resale. By placing your order on blomour.com, you are certifying that you are purchasing products for personal use only and not for resale. You may not use our products for illegal or unauthorized purposes.
1.14 The sales contract is considered concluded with the sending by Blomour of an order confirmation e-mail. The e-mail contains the customer data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to be able to print and archive the copy of the present conditions.
1.15 It is mandatory to verify the accuracy of the personal data contained in the above email and, if necessary, promptly notify Blomour of any corrections / changes to be made as indicated in the section Cancellation or modification of orders.
1.16 If you do not provide us with all the necessary information, Blomour may not be able to process the order.
1.17 We reserve the right to refuse an order or service to anyone, for any reason and at any time.

2. PRODUCTS & SERVICES
2.1 Some products or services may be available exclusively online, through the website https://www.blomour.com/.
2.2 Some products or services may have limited quantities and are subject to return or exchange under our Returns, Refunds and Exchanges Policy.
2.3 Prices are subject to change without notice.
2.4 We have made every possible effort to be able to display, as beautifully as possible, the colors and materials of the products for sale on this site. However, as the actual colors and materials you will see will depend on your monitor, we cannot guarantee that your monitor display will be accurate.
2.5 All descriptions of products or product prices are subject to change at any time without notice, at our sole discretion.
2.6 We do not warrant that the quality of any product, service, information or other material purchased or obtained by you will meet your expectations or any errors in the Sales Service or General Services will be corrected.
2.7 We reserve the right to discontinue production of any product at any time.

3. FLORAL PRODUCTS
3.1 Floral Product availability/seasonality: All our flowers are procured fresh from market and are seasonal in nature. Substitutions may be made from time to time where required and without prior notice. 
3.2 The flowers used in the arrangements and events are purchased fresh from local markets and are seasonal in nature.
3.3 Substitutions may be made from time to time where required and without notice at our discretion.
3.4 The products are made by hand and organic in nature. There may be small variations (such as blooms, colours and size) between the image presented on the website and the product received.


4. OBJECTS
4.1 The vases are handmade. There may be small variations (such as colors and sizes) between the image presented on the site and the product received.
4.2 They are often unique pieces and the reproduction cannot be the same and may vary slightly
4.3 Most of the vases and objects are created by hand and by different artists. We cannot guarantee a second order for the same product.


5. GIFT CARD

5.1 When you receive the order confirmation of a Gift Card, you will be contacted for more information: name of the person, address, message to combine with the gift card if you wish.
5.2 The person will receive the Gift Card via post office or directly at home if in Zone 1 / Zone 2 / Zone 3 / Zone 4 / Zone 5 (details at 12.1)
5.3 The Gift Card is personal and nominative
5.4 You will need an identity document.
5.5 We will welcome the person to whom the Gift Card is made out to in our Blomour shop and together we will choose the available flower arrangement and present our selection of plants and objects.
5.6 The Gift Card can be used one or more times during the six months following the purchase.
5.7 This item is non-refundable.

6. CLICK & COLLECT
6.1 If you do not receive an order confirmation, the service will not be available at that time.

6.2 Please allow 24 hours to process your order.

7. SUBSCRIPTIONS
7.1 Upon receipt of the subscription, we will contact the recipient to find out about preferences and establish the type of composition and the definition of the days and the time slot for deliveries.
7.2 Please allow 48 hours to process your order.

8. BILLING
8.1 The invoice will be issued by Blomour following receipt of payment and will be attached to the shipment of the products in the case of vases and objects.
8.2 In the case of deliveries outside Italy, the supplies may be subject to import duties and taxes, payable once the products supplied reach the specified destination.
8.3 Any cost of customs clearance will be the responsibility of the customer, who must also fulfill any obligation that the law places on the importer.

9. CURRENCY & PAYMENT METHODS
9.1 All prices shown on our website are in Euros
9.2 We accept Visa, Mastercard or American Express credit cards or local debit cards.
9.3 Wix provides us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Wix &  data storage, databases and the general Wix application. They store your data on a secure server behind a firewall.

10. SUSTAINABLE PRACTICES
10.1 We are committed to reducing our environmental impact whenever possible.
10.2 We do not use floral foam or plastic packaging in our compositions.
10.3 Our goal is to include at least 70% local ingredients in all our compositions.
10.4 To compensate for the CO2 emissions produced by our vehicles in deliveries, we balance this by directly financing small agroforestry projects that generate environmental and social benefits through
Treedom.com projects.
10.5 We deliver all unsold flower products and arrangements after an event to local Senior Residences.

11. PRIVACY & COOKIE POLICY
11.1 By using our Services and placing orders through them, you agree to share data and provide us with your email address, postal address and / or other contact details truthfully and accurately.
11.2 You also agree that we may use this information to contact you in the context of your order, if necessary.

12. DELIVERY AND SHIPPING POLICY
12.1 LOCAL DELIVERY OF FLOWERS, PLANTS AND POTS
Blomour offers local deliveries in the area listed below and they include arrangements, plants and pots.
The shipping charges for your order will be calculated and displayed at checkout, using the zip code checker. We will contact you by email, after payment has been made, to confirm the day of arrival of your order.
Local delivery charges are subject to change during peak periods (such as Valentine Day and Mother Day).
Please select the correct delivery area at checkout.
If you do not see your address, please email or call us to arrange delivery. If your delivery address is different from the selected price range please email us or call us to arrange delivery.
Delivery times may vary, both in the morning and in the afternoon.

12.2 DELIVERY CONDITIONS: FLOWERS
Please ensure that your recipient is available at the delivery location and during the delivery time slot to receive your floral product order. 
If at the time of delivery your recipient is unable to receive your floral product order, the courier will call the recipient to seek further instructions. If the recipient cannot be reached within 15 minutes of the courier&arrival, the flowers will be re-delivered to our shop and the sender will be charged a return cost and a handling and restocking fee of 10 Euros.
Floral products are delicate in nature, therefore we will not leave products outside of a recipient’s home or place of business. 
Orders will only be delivered after payment has been confirmed.

12.3 NATIONAL SHIPPING OF VASES & OBJECTS
The shipping charges for your order will be calculated and displayed at checkout. Rates are based on the weight of the package and the shipping destination.
Please allow up to 5 days for order confirmation. We are a small team and we appreciate your patience!
The normal delivery time is 1-3 weeks (All items in your order will be delivered at the same time, unless otherwise specified).
Several products are made to order, please note that production time can take up to 30 days.
Non-floral products will be delivered to the address of the recipient with or without the presence of the recipient.
If a package is returned and the buyer has not cleared it, Blomour does not send the replacements.

12.4 INTERNATIONAL SHIPPING VASES & OBJECTS
The shipping charges for your order will be calculated and displayed at checkout. Rates are based on the weight of the package and the shipping destination.
Your order may be subject to import duties and taxes, which are applied once the shipment reaches the destination country.
Please allow up to 5 days for order confirmation. We are a small team and we appreciate your patience!

12.5 IMPORT TAXES, CUSTOMS DUTIES AND TAXES
All shipments destined outside Italy are subject to import taxes and customs duties.
International delivery costs do not include any taxes or duties that may be applied by customs in the destination country
All duties or taxes incurred are the responsibility of the recipient.
Blomour has no control over this and cannot be held responsible for any of these taxes or duties, and is not responsible for any action taken by customs on the package during delivery.
In accordance with the export regulations of Italy, Blomour is required to declare the exact value of all items.
For more information on taxes, duties and customs regulations, please contact your local customs office directly.
If the recipient refuses to pay taxes + duties or refuses delivery for any other reason, the items will be returned to our store in Italy.
The order will only be refunded once the item is returned, excluding the return shipping costs, the original shipping costs and a 20 € handling and restocking fee will be deducted from the order amount.

13. POLICY OF RETURNS, REFUNDS AND EXCHANGES OF GOODS.

Please keep your purchase receipt.

13.1 PRODUCT CHANGES
In case you have mistakenly ordered an incorrect product, we recommend that you send us an email as soon as possible at hello@blomour.com with your order number and at least three photos of the item.
If the item is unused and in its original condition, your order will only be refunded once the item is returned, excluding return shipping charges and original shipping charges.

13.2 WRONG or DAMAGED ITEM
We check all products meticulously, but in the event you have received the wrong item or damaged due to our error we recommend that you send us an email within 14 days after delivery to hello@blomour.com with your order number and at least three photos of the article.
The order will only be refunded once the item is returned, but we reserve the right to investigate on a case-by-case basis.

14. CANCELLATION OR MODIFICATION OF ORDERS

14.1 CANCELLATION OF FLOWER ORDERS
In the event of canceling a flower order, you must call us within 12 hours of delivery, before it is set up for shipment.
Cancellations by e-mail or messaging are not accepted.

14.2 CANCELLATION OF ORDERS OF VASES TO ITALY AND ABROAD
In case of cancellation of an order for a vase or an object, it is necessary to cancel the order within 24 hours of the request sent.

15. DISCLAIMER OF WARRANTIES: LIMITATION OF LIABILITY

15.1 Blomour assumes no responsibility for inefficiencies attributable to force majeure if it fails to execute the order within the time stipulated in the contract.

15.2 Blomour cannot be held responsible, except in the case of willful misconduct or gross negligence, for disservice or malfunctions related to the use of the Internet outside of its own control or that of its suppliers.

15.3 Blomour will also not be liable for damages, losses and costs incurred as a result of the non-execution of the contract for reasons not attributable to it, having the right only to the full refund of the price paid and any ancillary charges incurred.

15.4 Blomour assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards or other means of payment, for the payment of the purchased products, if it proves that it has adopted all possible precautions based on to the best science and experience at the time and on the basis of ordinary diligence.

15.5 In no case can you be held responsible for delays or errors in payment if you can prove that you have made the payment in the times and methods indicated by Blomour.

15.6 Neither we, nor any courier services we use, will be liable for any failure or delay in performance, if such error or delay is due to unforeseeable circumstances and beyond our reasonable control; these circumstances include but are not limited to accidents, extreme weather conditions, floods, fires, traffic congestion, riots, terrorism, strikes - including acts of God, natural disasters or any change in laws or regulations (Force Majeure)

16. GOVERNING LAW / DISPUTE RESOLUTION

16.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy and shall be subject to the non-exclusive jurisdiction of the courts of Italy.
